Answer: Ethical dilemma: In the given scenario, the ethical dilemma arises when the position of the attending physician gets in contradiction with his own duties. On one hand, the code of conduct for doctors provides that he should attend to his patients in case of health issues. On the other hand, it is also imperative under the Codes of Professional Ethics under the Nursing and Midwifery Board of Australia that the health practitioner should take the permission of the patient whom he intends to treat. In the given situation, the patient is a child and hence, the permission of his guardians has to be taken by the doctor ('Ethical Dilemmas in Nursing', 1986). Since the childs mother objects to the treatment of the child and his father is not with him at the moment, hence the doctor cannot initiate a treatment that is essential. Thus, the professional dilemma that arises here is that there arises a conflict between the primary responsibility of the health practitioner to give medical assistance to the child o n one hand and the responsibility to seek for the permission to initiate the treatment on the other hand. If the health practitioner fails to meet with either of the two requirements, he shall be making a breach of his duty and thus is stuck in an ethical dilemma (Gair, 2013). Decision-making model: The decision making model that can be selected in this matter is the DECIDE model as prescribed by the NCBI (KL, 2015). The DECIDE model is the ellipsis of six meticulous activities required in the decision making process. The steps as provided in the model are enlisted as follows: D = Defining the problem under the Health Issue E = Establishing the criteria for the selected health care measure C = Considering all the alternatives that are available in the situation I = Identification of the best alternative out of the given ones D = Developing a proper executable plan of action under the scenario E = Evaluating the solution and monitoring the health issue under the selected alternative. Application of the Model: Using this model, the dilemma can be resolved effectively. The health issue here is that of meningitis which requires immediate attention. The victim here is a kid who has acute symptoms of vomiting and convulsions. He is going through a lot of suffering and if the treatment is not started immediately, his condition is likely to worsen. The alternatives available here are either to treat the child or allow him to suffer and of these two, it shall be wise to start the treatment of the child which if ignored may result in complications. In order to achieve the requirement, what can be done is, initially, to relieve the child of his vomiting tendencies, he can be given certain medications to ensure that his condition does not deteriorate and he remains stable (Stahl, 2014). Then, a wait for the appearance of his father can be made who can be explained the actual health situation of the child and further treatment can be carried on in this regard (Campbell, 1997). This model if adhered to can help in solving the ethical dilemma that has arisen in the situation to a certain extent and can also ensure that none of the responsibilities of the health practitioner are violated in the matter. Explanation dialogue: Being the parents of the child, it is very important that they should understand the critical condition through which the child was going. He was in a complete state of acute health problem. Hence it was very necessary looking at the deteriorating condition of the child that he should receive immediate medical help. If the help would not have been extended, the child could have died of meningitis or even if we would have waited to seek for another independent medical advice, the child would have gone through acute suffering to a greater extent. Thus, it was necessary that the child should have been given immediate medical attention. Moreover, no medical assistance was provided for treating meningitis in the given case. Rather, the convulsions and the vomiting was tried to be treated so that some amount of relief could have been given to the child. Being doctors, it is our foremost important duty to make sure that no patients undergo suffering which is under our control. If the treatm ent was not give, at time, then, the condition could also have worsened to such an extent that treatment would not have been possible and nothing would have remained under control. Chinese martial arts Essay Shamis: Way to Shaolin is a traditional dance performed by the Kung Fu Monks of Shaolin. Dance exists in many forms and can fulfil different functions: ritual, social or artistic. This particular dance fits into the ritual and artistic function. When performed and practised, ritual dance serves a strong function in sustaining the life of people through the culture and its procedures. Artistic dance is performed to be looked at and to entertain onlookers. The work itself can also be a means of expressing ones thoughts and feelings (Snook. B, 2004, p47-49). This essay will prove that the ritual function is most predominant in Shamis: Way to Shaolin. The ancient collection of Chinese martial arts referred to as Shaolin Kung Fu was created by a Buddhist Monk called Bodhidharma or Tamo who attempted to teach the monks of Shaolin the discipline of Zen meditation. They were not physically capable for the rigorous regime so he then continued to create a series of exercises to build up their health and increase their stamina (History of Shaolin Kung Fu, N/D, para 2). The exercises were both physiological and physical; the â€Å"goal being to control the body through the power of the mind† (The History of the Shaolin Monastery, 2008, para 1). The martial arts were developed out of necessity as the monks had to defend the monastery from thieves who tried to rob them of their treasures (History of Shaolin Kung Fu, N/D, para 3). Today, Shaolin Kung Fu is still practised and used for self-defence, health, fitness, character development, spiritual cultivation and life enrichment (Aims and Objectives of Practising Kung Fu, ND, para 3, 4 and 6). The ritual function is clearly the most predominant function in the performance of Shamis: Way to Shaolin, because of the great history and meaning of Shaolin Kung Fu to the Buddhist monks and the way it is performed. The dance components in Shamis: Way to Shaolin clearly fulfil the ritual function of dance due to the culture and beliefs represented. The dancers are all male Chinese Buddhist monks and they are wearing traditional outfits. The orange robes are dated back centuries and were originally chosen because of the dye available at the time. They are meant to symbolize simplicity and detachment of materialism (Exotissimo, 2010, para 1). The dancers are respecting themselves and others as they all bow together at the beginning of the performance and stand in a meditation position on one leg before dancing. The thin, wooden poles used in the performance of Shamis: Way to Shaolin are martial art weapons used for defence. The monks are representing themselves as warriors protecting their beloved monastery which is part of their history. This is realised as the stage is representing the outside of their monastery with large doors opening outside to steps which lead downwards and have 2 Chinese statues guarding them. The movements of the Shaolin monks are also very sharp and aggressive. They shout HA! loudly together on particularly strong movements as a warning signal and to show it is their territory and monastery. This is a characteristic of ritual dance as the performance is portraying a function. The dancers engage themselves entirely on the performance using immense concentration and focus. Repetition, a characteristic of ritual dance, is used as the monks repeatedly twirl their poles and bang them on the ground. The ritual function is most predominant as the Buddhist monks are dancing for themselves for enlightenment as well as for their culture and beliefs. There are also dance components that fulfil the artistic function of dance within Shamis: Way to Shaolin. It is choreographed and performed onstage for an audience. The dance begins with a loud gong and then fast-paced, traditional music is played which is whistling and chiming. The music is played to assist the audience in understanding and enjoying the performance. The monks mostly all dance together in sync at the same time, the majority of the time in a 3 straight lined formation facing the audience. This is an artistic element because the dancers have practised their routine so that it would be appealing to watch. A smoke machine is used when the male dancers enter onto the stage and go down the steps which provide levels within the performance. Levels are again used during the dance because they are regularly leaping, crouching and jumping. At the end most of them go to either side and sit while watching 2 monks fight dance with poles in the middle. These components are all used for the benefit of the audience and the overall effectiveness of the dance. Therefore the dance is also clearly fulfilling the artistic function. The ritual and artistic functions are seamlessly combined in this dance. The artistic function includes music, formations, cannons and levels. The ritual function is more complex representing their culture and beliefs with the dancers being Buddhist monks, wearing traditional outfits, doing meditation and Martial Arts/Kung-Fu etc. Together the two functions create an unforgettable production with the ritual being the most predominant. Background In the Western world, the schism within the Catholic Church has made its most significant impact due to rapid changes in social standards. Of greatest importance is the evolution of modern society and their response to the reverberated traditions of the Catholic Church as well as the evolving Protestant sects. In consequence of increases in technology and science, modern society has redefined its acceptable and moral behavioral standards within a social setting, whereas, the Catholic Church stands firm in its doctrines despite social and moral movements in the twentieth century. Except for the Second Vatican Council and the Council of Trent, the Roman Catholic Church has not worked to revise its religious traditions in response to a changing society. As a consequence with this unparalleled development, many young adults and the population in general has swayed from the devout Catholic worship.1 From my personal experience I have found it difficult to accept the strict doctrines of the Catholic Church due to a social lifestyle that takes precedent. Secondly, I have appreciation for other religions, particularly Hinduism and sects within Christianity. My attitude does not necessarily correspond with that of the Catholic Church. Specifically, the Catholic Church perceives itself as the only divine route to Heaven. From my perspective, having been born and raised Catholic, I feel that Catholicism strongly disfavors any exploration of other religions or even tolerance of additional religions. I feel that this intolerance is subtly communicated to worshipers. Even if this intolerance it not communicated, there are not measures taken to inform worshipers about other religious practices. This stance is probably ... ...ery emotional responses such as tears. However, this should not be a discouragement because all Catholics are very sensitive to this dramatic difference in celebrating God and it does take time to get use to. Mainly it must be known that whether Protestant or Catholic we are worshipping to the same God. By taking a step back and analyzing the differences in religious celebration of this mystery, one can realize the true similarities between the too. It is said that we can judge a man’s character from his dress; But it’s not always so. Dress can only help us to a certain extent in knowing the broad facts of a man’s character. A man who wears a costly dress is necessarily a man of lavish habits. On the other hand, a man who wears tattered clothes is not necessarily a man of miserly habits. He may be do so only due to his financial limitations. Yet it is true that in some cases dressserves as a useful index to the character of a man. Some common examples, from which we can get some idea of a man’s character from his dress, are given below. We daily come across such persons as put on clothes of loud colours. We find them dressed in gaudy colours. They wear bushshirts printed withThe faces factors and actresses. So, is the case with their shoes. Shoes withdifferent designs on them are liked by them. We can easily know thecharacter of such people by looking at the way in which they dress. Suchpeople, if we carefully observe them, are very fond of show and ostentation. They lack the maturity of taste. They do not have sober habits. We can know this by their dress. Many people even if they are given costly and decent clothes, will maketheir appearance shabby and ineffective. They will put on the shirt or thecoat, but will not button it up. The laces of their shoes will remain untied. If they use the tie they will not put the knot properly. They never botherwhether their clothes are pressed or not. As these people are with theirclothes, so they are with their habits. They behave carelessly in other matters also. They are slovenly in their dress, living, reading and other ways also. So in this way, dress reflects their character. Besides this, we find people wearing very simple dress. A white ‘kurta’,‘dhoti’, and a white cap on the head and simple ‘chappals’ are all that they dress themselves in. But their clothes are always very neat and clean. Though they do not waste much of their valuable time in dressing, yet they do not use their dress carelessly. Such people show that they are thefollowers of the principle, â€Å"Simple living and high thinking†. They do notbelieve in ostentation. Mostly such people are intellectual. Broadly speaking, the dress of a man helps us to know his character. But atthe same time it may also be added that the dress should not be regarded as the sole index to the character of a man. Many saints and Sadhuscompletely neglect their dress. But it does not mean that they are very low either in their mental or emotional standard. On the contrary, they raise themselves so high from the level of such worldly considerations that dress becomes quite meaningless to them. In the present age, Mahatma Gandhiused to wear only a loin cloth. But he was the man before whom the entire world bowed its head. So in judging the character of a man dress can kelp us only to a certain extent. It can never be the sole guide. We should alsotake other factors into consideration in judging a man.

Jeb Stuart essays Jeb Stuart was a combination leadership general in the mid-nineteenth century. He was a great leader as well as a good follower. In the following paragraphs I intend to tell about his life before the army and his life during his service, explain why he was such a great leader, and discuss the roles he played in the battles he fought. Every great story has a beginning. This one is no exception. James Ewell Brown Stuart was born on February sixth, eighteen thirty-three. He was the seventh of twelve children and the youngest son. Stuart attended Emory and Henry College before being appointed to the United States Military Academy. He graduated thirteenth out of forty-six in his class and was appointed cavalry sergeant, which was the highest rank attainable for these cadets. After graduation Stuart of course entered the U.S. army and because of his participation in the military academy was given the rank of second lieutenant, and was assigned to the regiment of the Mounted Texas Riflemen. He excelled in leading the regiment, and was promoted and transferred to the newly formed first Regiment, U.S. Cavalry. On January fifteenth, eighteen sixty-one Jeb sent a letter to Jefferson Davis asking him for a position in the confederate army. On May third of the same year he sent his letter of resignation to the U.S . army, and three weeks later was given the rank of captain of the southern cavalry. This didn't last too long due to Stuart's superb skills. At the end of it all he was promoted to major general of the entire confederate cavalry division. Stuart was in many battles in the Civil War, some he played a vital role in, others not. His first service was in the Shenandoah Valley, but he was at First Manassas where he nipped at the Union right flank, and then tried to organize a pursuit. After that he had an unusual role. Act 2 of Reasons to Be Pretty Reasons to Be Pretty is a hard-edged comedy written by Neil LaBute. It is the third and final installment of a trilogy. The trio of plays (which also include The Shape of Things and Fat Pig) are connected not by characters or plot but by the recurring theme of body image within American society. Reasons to Be Pretty premiered on Broadway in 2008. It was nominated for three Tony Awards (Best Play, Best Leading Actress, and Best Leading Actor). The following is a summary and analysis of the events in Act Two. Read the synopsis and character outline of Act One. Scene One - After the Break Up Act Two of Reasons to Be Pretty begins in the lobby of a restaurant. Steph and Greg unexpectedly encounter each other. Steph is on a date, and the former couple awkwardly make small talk, attempting to be pleasant. The conversation segues to nostalgia for their good times together, which then transitions into the familiar argument about body image and their break up. She smacks him, then just as suddenly tries to apologize. However, Greg has had enough. He tells her that her date will eventually hurt her feelings too, and that he wont be there to help her. Somehow, they cool down and wish each other well on their lives without one another. Scene Two Carly visits Greg (who is yet again reading some classic literature). He comments that has not seen Kent lately. After trying to flatter him, Carly then wants to ask him an important question about Kent. Before the question, Carly reveals that she is three months pregnant. She suspects that Kent is cheating on her. At first, Greg contends that he does not believe that Kent is unfaithful. Carly continues to pressure him, asking Greg to look her in the eye and say he doesnt know anything. She asks if Greg was out with Kent and girls, but Greg lies and says that it was just guys from work. This relieves Carly for the time being. She tells him: I dont know why God made it so hard for us to trust you guys but he did, and it sucks. Scene Three Greg and Kent prepare for work-related softball game. Kent says that he expects Carly to hit the gym the day after the baby is born. He thanks Greg for covering up his affair, and begins to recount his recent sexual exploits with Crystal, the hot girl from the office. Greg tries to explain that he no longer lie about Kents affair. This irks Kent, who feels that Greg is being judgmental. He repeatedly calls Greg a pussy. Greg tries to get the upper hand, hinting that he might tell Carly the truth, but Kent believes that he is bluffing. He claims that Greg would never tell because he is afraid of people disliking him. Kent bullies him, wrestles him to the ground, and then calls his ex-girlfriend ugly. Greg finally stands up to Kent, not just because he is obnoxious, not just because he is an adulterer, and not just because of his comments about Steph. Before he beats Kent up, Greg explains that he is doing it Because you need it, okay? For who you are and what you have done, and for all the sh*t you will no doubt perpetrate for the rest of your life. After over-powering his ex-friend, Greg leaves Kent, who fumes in rage. Scene Four Carly and Greg are hanging out in the break room. She chats about her pregnancy. In hopes of showing Carly the truth about her husband, Greg strongly suggests that she takes the evening off and go home to her husband. She follows his advice. Although we never see the confrontation between Carly and Kent, it is implied that Carly will discover the truth about her husbands affair, and will move onto a new chapter in her life. Immediately after Carly leaves, Stephanie stops by to share the news: she is engaged to be married. Steph has become a manager at her hair salon. Greg has plans to go to college, realizing that he doesnt want to work at a warehouse for the rest of his life. Steph admits that she cannot stop thinking about Greg, yet at the same time believes that she will be much happier with her soon-to-be husband. Greg apologizes and is very understanding. He emphasizes that she has a pretty face, making her feel better. He also admits that he is simply drifting, and that their four years together may never have turned into marriage. She leaves, but not before kissing him good bye one last time. Although they do not rekindle the relationship, the characters in Reasons to Be Pretty represent a rather optimistic view on relationships and young, middle class Americans. In comparison to the protagonist in Fat Pig, Greg exhibits both courage and selflessness by the end of the play.

These qualities help an individual in assuring the employer that she/he can fully fit into the compa ny and its core culture (Allen, 2011). My experience was quite challenging, but the results were impressive since I was accepted into the company. I answered the questions comfortably and portrayed other personality attributes that were instrumental. Exemplary interpersonal and communication skills were evident, as well as confidence and enthusiasm among others. The interview was successful due to the fact that I was able to answer the questions in the best way. This can be attributed to the issue of merit, but it was also influenced by extensive research about the company. I carried out some research about the company prior to the interview; thus, I had relevant knowledge on the interviewer’s expectations. I may comfortably state that this was the biggest reason as to why I got employed. However, it is pertinent to note that other issues also contributed towards the achievement. This can be exemplified by my ability to volunteer crucial personal information about my strength s and weaknesses also enhanced my quest. B. My second experience was also a job interview and it characterized most aspects that relate to such practices. In this case, I was also targeting a part time job in a manufacturing company during the holidays. I was confident that I would be successful since I had already participated in a similar exercise in the past. The professional part of the conversation was evident, and I managed to convince the interviewer that I had great interest in a supervisor’s job. I proved to the interviewer that I was the right person for the job through my intense knowledge of the company. This knowledge resulted from research about the company and general knowledge obtained from previous stints in school. My dress code depicted the image of a successful and ambitious person, and it unequivoc ally propelled my chances to greater heights. I answered the questions in the best way possible and maintained my composure throughout the interview. However, there are aspects that I failed to consider during the interview, and they specifically led to complications and disqualification in the long run. There was no doubt that I did merit for the job, but these smaller aspects that I failed to observe changed the entire scene. It is seen and analyzed both as a principle of environmental economics and as a principle of environmental law. In environmental economics, it is discussed as an ef? ciency principle of internalization of environmental costs. As a legal principle, it is usually treated as a principle for the allocation of the cost of pollution prevention, and for liability and compensation for environmental damage. In general, it is regarded as an important and ‘right’ principle in the perspective of environmental protection. It is often mentioned together with other major environmental principles such as the precautionary principle, the principle of prevention and the principle of integration. In 1972, the Organisation for Economic Co-operation and Development (OECD) articulated the principle explicitly and in 1989 indicated that it should be applied to agriculture. Though the principle originated as an economic principle, since 1990 it has been recognized internationally as a legal principle. The PPP now plays an important role in national and international environmental policy. The European Community (EC) adopted the principle in the 1987 Single European Act, and it has appeared in international agreements, including the Rio Declaration of 1992. The principle is an explicit part of legislation in some nations; in others, it is an implicit subtext for both environmental regulation and liability for pollution. Historical Evolution Of Polluter Pays Principle The polluter pays principle, like the other great towering principles that today influence international environmental law, such as: (1) the sustainable development principle; (2) the prevention principle; (3) the precautionary principle; and (4) the proximity principle, started as a political declaration without legal force. The polluter pays principle has been included in documents with legal status. For instance, many modern constitutions in the European Union explicitly provide for a right to a clean environment and thus environmental policy principles also constitute environmental law. The right to a clean environment implies a duty of the state to protect its citizens, but it is questionable whether these principles or social rights can yet be considered subjective rights, meaning that they can be enforced by citizens in a court. However, some see the right to a clean environment as a human or natural right existing independently of politically decided treaties. Finally, the polluter pays principles is now seen in specific pieces of legislation becoming more (or some might say ‘less’) than a grand constitutional statement of an intractable human right. OECD – the birth of the polluter pays principle Some explanation of the sometimes arbitrary course of the principle of polluter pays can be found in its historical development. The principle first appeared in a legal context in a document prepared by the international Organization for Economic Cooperation and Development (â€Å"OECD†) and included the following recommendation: â€Å"The principle to be used for allocating costs of pollution prevention and control measures to encourage rational use of scarce environmental resources and to avoid distortions in international trade and investment is the so-called ‘Polluter Pays principle’. This principle means that the polluter should bear the expenses of carrying out the above mentioned measures decided by public authorities to ensure that the environment is in an acceptable state. In other words, the cost of these measures should be reflected in the costs of goods and services which cause pollution in production and/or consumption. Such measures should not be accompanied by subsidies that would create significant distortions in international trade and investment†. In 2001, the OECD Joint Working Party on Agriculture and Environment, after years of gestation and development by other organisations, stated that a new and expanded form of the polluter pays principle should provide that: the polluter should be held responsible for environmental damage caused and bear the expenses of carrying out pollution prevention measures or paying for damaging the state of the environment where the consumptive or productive activities causing the environmental damage are not covered by property rights. United Nations – the Rio Declaration This proclamation was proved, at least on paper, if not yet by jus cogens, in 1992 when the United Nations Conference on the Environment and Development delegates agreed on the Rio Declaration on Environment and Development (the â€Å"Rio Declaration†), which has been described as an â€Å"instrument of international jurisprudence [that] articulates policies and prescriptions directed at the achievement of worl dwide sustainable development†. It is of note that Principle 16 of the Rio Declaration provides that: â€Å"[n]ational authorities should endeavour to promote the internalization of environmental costs and the use of economic instruments, taking into account the approach that the polluter should, in principle, bear the cost of pollution, with due regard to the public interest and without distorting international trade and investment†. The principle’s appearance in such a seminal statement of the undamental principles of international environmental law demonstrates its significance in environmental liability regimes around the world. United States The principle has to some extent informed United States’ legislation, but its influence should not be overstated and commentators note that: â€Å"The United States, in contrast to the European nations, does not officially recognize the [polluter pays principle] as a distinct principle or policy mandate, but does, by natural political and economic inc lination, closely follow its precepts in practice†. Certain provisions of the United States’ Clean Air Act 1970 (the â€Å"CAA†) and Clean Water Act 1977 (the â€Å"CWA†) require polluters to satisfy environmental standards at their own expense; and the Comprehensive Environmental Response, Compensation and Liability Act of 1980 (â€Å"CERCLA†) assigns liability for costs associated with cleaning-up sites contaminated by hazardous wastes. CERCLA is a notable milestone in the development of the polluter pays principle in the United States and commentators have noted that: â€Å"the polluter pays principle is one of the central objectives or goals of CERCLA†. Flaws in the Polluter Pays Principle Few people could disagree with what seems at first glance to be such a straightforward proposition. Indeed, properly construed, this is not only a sound principle for dealing with those who pollute but is an extension of one of the most basic principles of fairness and justice: people should be held responsible for their actions. Those who cause damage or harm to other people should pay for that damage. This appeal to our sense of justice is why the polluter pays principle (PPP) has come to resonate so strongly with both policy makers and the public. As a general rule, sound economic analysis of pollution and environmental problems must also be based on the principle of responsibility. Forcing polluters to bear the costs of their activities is good economics too; it not only advances fairness and justice, but also enhances economic efficiency. In other words, with appropriate policies based on a PPP, we should not have to give up the economic efficiency of a free market system based on private property in order to obtain environmental protection, nor vice versa. But as with most such general principles, the devil is in the details. In this case, the details relate to three basic questions that any application of the PPP must answer. First, how do we define pollution and therefore a polluter? Second, how much should the polluter pay, once he is identified? Third, to whom should the payment be made? The answers to these questions are at the heart of whether any application of the PPP will be either just or economically efficient. A correctly construed polluter pays principle would penalize those who injure other people by harming their persons, or by degrading their property. Too often, however, the PPP is misdefined and misused to suppress private economic activity that benefits the parties directly involved and does no specific damage to other people, but which offends those who oppose human impact on the environment and prefer to leave resources undeveloped. The objective is to restrain the resource use at the expense of the property owners and consumers without cost to those who wish to see the resources remain idle. Under such a misapplication of the PPP, very often a polluter is not someone who is harming others, but is someone who is simply using his own property and resources in a way that is not approved of by government officials or environmentalists. In such cases there is no harm to be measured and no real victims to compensate. Consequently, the amount to be paid is not determined by the extent of any actual damage done. Rather, it is set at a level that curbs the politically disfavored activity to the degree desired by its opponents. And finally, the payment (whether there are real victims or not) typically goes to the government in the form of a tax. In other words, in most cases, the PPP is used as cover to promote a political or ideological agenda rather than to ensure that real polluters pay compensation to real victims of their activities. Constitutional and Legislative Measures Stockholm Declaration of 1972 was perhaps the first major attempt to conserve and protect the human environment at the international level. As a consequence of this Declaration, the States were required to adopt legislative measures to protect and improve the environment. Accordingly, Indian Parliament inserted two Articles, i. e. ,, 48A and 51A in the Constitution of India in 1976, Article 48A of the Constitution rightly directs that the State shall endeavour to protect and improve the environment and safeguard forests and wildlife of the country. Similarly, clause (g) of Article 51A imposes a duty on every citizen of India, to protect and improve the natural environment including forests, lakes, river, and wildlife and to have compassion for living creatures. The cumulative effect of Articles 48A and 51A (g) seems to be that the State as well as the citizens both are now under constitutional obligation to conserve, perceive, protect and improve the environment. Every generation owes a duty to all succeeding generations to develop and conserve the natural resources of the nation in the best possible way. The phrase ‘protect and improve’ appearing in both the Articles 48A and 51A (g) seems to contemplate an affirmative government action to improve the quality of environment and not just to preserve the environment in its degraded form. Apart from the constitutional mandate to protect and improve the environment, there are a plenty of legislations on the subject but more relevant enactments for our purpose are the Water (Prevention and Control of Pollution) Act, 1974; the Water (Prevention and Control of Pollution) Cess Act, 1977; the Air (Prevention and Control of Pollution) Act, 1981; the Environment (Protection) Act, 1986; Public Liability Insurance Act, 1991; the National Environment Tribunal Act, 1995 and the National Environment Appellate Authority Act, 1997; the Wildlife (Protection) Act, 1972; the Forest (Conservation) Act, 1980. The Water Act provides for the prevention and control of water pollution and the maintaining or resorting of the wholesomeness of water. The Act prohibits any poisonous, noxious or polluting matter from entering into any stream or well. The Act provides for the formation of Central Pollution Control Board and the State Pollution Control Board. The new industries are required to obtain prior approval of such Boards before discharging any trade effluent, sewages into water bodies. No person, without the previous consent of the Boards shall bring into use new or altered outlet for the discharge of sewage or trade effluent into a stream or well or sewer or on land. The consent of the Boards shall also be required for continuing an existing discharge of sewage or trade effluent into a stream or well or sewer or land. In the Ganga Water Pollution case, the owners of some tanneries near Kanpur were discharging their effluents from their factories in Ganga without setting up primary treatment plants. The Supreme Court held that the financial capacity of the tanneries should be considered as irrelevant while requiring them to establish primary treatment plants. The Court directed to stop the running of these tanneries and also not to let out trade effluents from the tanneries either directly or indirectly into the river Ganga without subjecting the trade effluents to a permanent process by setting up primary treatment plants as approved by the State Pollution Control Board. The Water (Prevention and Control of Pollution) Cess Act, 1977 aims to provide levy and collection of a cess on water consumed by persons carrying certain industries and local authorities to augment the resources of the Central Board and the State Boards constituted for the prevention and control of water pollution. The object is to realise money from those whose activities lead to pollution and who must bear the expenses of the maintaining and running of such Boards. The industries may obtain a rebate as to the extent of 25% if they set up treatment plant of sewage or trade effluent. The Air Act has been designed to prevent, control and abatement of air pollution. The major sources of air pollution are industries, automobiles, domestic fires, etc. The air pollution adversely affects heart and lung and reacts with hemoglobin in the blood. According to Roggar Mustress, the American Scientist, air pollution causes mental tension which leads to increase in crimes in the society. The Air Act defines an air pollutant as any solid, liquid or gaseous substance including noise present in the atmosphere in such concentration as may be or tend to be injurious to human beings or other living creatures or plants or property or environment. The Act provides that no person shall without the previous consent of the State Board establish or operate any industrial plant in an air-pollution control area. The Central Pollution Control Board and the State Pollution Control Board constituted under the Water Act shall also perform the power and functions under the Air Act. The main function of the Boards under the Air Act is to improve the quality of air and to prevent, control and abate air pollution in the country. The permission granted by the Board may be conditional one wherein stipulations are made in respect of raising of stack height and to provide various control equipments and monitoring equipments. It is expressly provided that persons carrying on industry shall not allow emission of air pollutant in excess of standards laid down by the Board. In Delhi, the public transport system including buses and taxies are operating on a single fuel CNG mode on the directions given by the Supreme Court. Initially, there was a lot of resistance from bus and taxi operators. But now they themselves realise that the use of CNG is not only environment friendly but also economical. Noise has been taken as air pollutant within the meaning of Air Act. Sound becomes noise when it causes annoyance or irritates. There are many sources of noise pollution like factories, vehicles, reckless use of loudspeakers in marriages, religious ceremonies, religious places, etc. Use of crackers on festivals, winning of teams in the games, and other such occasions causes not only noise pollution but also air pollution. The Air Act prevents and controls both these pollutions. The Environment (Protection) Act, 1986 was enacted to provide for the protection and improvement of the quality of environment and preventing, controlling and abating environmental pollution. The Act came into existence as a direct consequence of the Bhopal Gas Tragedy. The term environment’ has been defined to include water, air and land, and the inter-relationship which exists among and between water, air and land and human beings, other living creatures, plants, micro-organism and property.

It's All Downhill From Here 8:02 a.m. Saturday. It's still dark, as usual, on these cold, winter days. Everybody else is still sleeping and enjoying the comfprting heat of their beds. I crack open the locked window by my bed, an act some deemed downright idiotic. I strip off my pj's, throw on my robe, and head for the shower. Drying off, I think about where I am abou to go. I dress piece by layered piece. I can't wait to hit the slopes! I round up my tools: body, boards, boots, bindings. Everything is in working order and ready for take-off. As I open the front door, I am shocked by the cold and fight my way through the wind to my car. I turn the key and put the heater on full blast. I am almost there. I step out of my car and survey the parking lot. Not too many cars. That's the way I like it. I take a deep breath and savor the frsh air. Already, I can feel the pressure of deadlines lifted off my chest. I strap my skis on, and prepare not just to tackle a run but other situations in my life as well. I skate over to the first pitch of the double diamond slope, and map out where I will take the first couple turns. It is almost like I am assessing my goals in life: getting accepted into Syracuse, owning a house in Colorado, raising a healthy family. I appreciate the sound of carving the first turn as if it was my very last. The crunching of the snow under my feet empowers me to crush the antagonists in my everyday life. The second and third turns secure my self-confidence. Only with the fourth turn do I start to realize that things are not always that easy. I heard it said often, "It's easier said than done." I never believed it until now. I only skid slightly over a patch of ice, but it is enough to start my heart thumping. I am suddenly aware that to finish this run or to reach my goals, I have to be ready for the tricky spots. I know that at any moment I could fall and be forced to start over. My lifetime goals can be affected by any number of things - grades slipping, drugs and alcohol - and I have to be ready to handle anything.
